North Carolina DWI Laws & Penalties for Commercial Drivers

For non-commercial drivers aged 21 and over, the legal BAC limit is 0.08 percent. However, for commercial drivers operating a commercial motor vehicle (CMV), the legal BAC limit is 0.04 percent.

CDL holders face a one-year suspension--or a three-year suspension if they were transporting hazardous materials at the time of the arrest--of their commercial driving privileges upon their first DWI conviction. This is in addition to the penalties imposed on non-commercial drivers, which may include fines, probation, mandatory substance abuse assessment, and potential jail time.

A second DWI conviction for a CDL holder results in a lifetime suspension of their commercial driving privileges, regardless of whether the offenses occurred in a commercial or non-commercial vehicle.

Keep in mind, similar to non-commercial drivers, CDL holders in North Carolina are subject to implied consent laws. This means that by obtaining a CDL, drivers consent to submit to a chemical test (breath, blood, or urine) if law enforcement suspects them of impaired driving. CDL holders who refuse to take a chemical test upon arrest may face a one-year suspension of their commercial driving privileges for a first offense and a lifetime suspension for subsequent offenses.
